The Court refused leave to appeal because the trial judge properly admitted the cautioned statements after finding them voluntary, the judge’s adverse credibility findings were reasonably open on the evidence, there was no basis to conclude the convictions were unsafe despite lack of positive identification, and the sentences conformed to applicable sentencing guidelines and were not excessive.
