Leave to appeal was granted limited to the reasonably arguable ground that the Court of Appeal departed from the prevailing sentencing guideline at the time of the offence thereby causing substantial and grave injustice; leave was additionally granted for the 5th and 6th applicants on the distinct ground that the Court of Appeal may have failed properly to consider s.109A of the Criminal Procedure Ordinance; leave was refused on the certified questions because they were already answered in Secretary for Justice v Wong Chi Fung & Others and on other grounds for lack of sufficient merit.
