The trial judge correctly found the messages were specific, repeated and planned and thus objectively capable of causing fear; defence lay and expert evidence did not establish that appellant's mental condition negated the specific intent to cause fear at the times of the messages; on re‑hearing the Court is satisfied beyond reasonable doubt that the conviction is safe and must be upheld.
