There was insufficient evidence to conclude beyond reasonable doubt that the third appellant exercised the domination or command over the lorry required by s.16; the presumption of knowledge was therefore improperly invoked and, because the jury were not directed to consider aiding and abetting absent the presumption, the conviction could not stand and must be quashed.
