The magistrate erred in law in declining jurisdiction; the offence under s.6(4) Crown Land Ordinance is a summary offence properly to be heard and determined by the magistrates' court, the Attorney-General acts for the public in bringing the information, and s.12 New Territories Ordinance does not oust magistrates' jurisdiction; accordingly mandamus was appropriate to compel the magistrate to hear and determine the information.
