Police officers in Hong Kong are Crown servants; s.4(3) Cap.300 renders the Crown vicariously liable for torts committed by officers while performing statutory functions as if those functions were by Crown instruction; however where an officer's conduct is a total, malicious abuse of statutory power amounting to a complete departure from duty, the act falls outside the scope of employment and the Crown is not liable; on these facts the abuse was total and the Crown was not liable.
