The Governor's power under section 3 Cap.124 is an administrative discretion exercised for public policy reasons; the statutory scheme (s.3 read with s.4 and s.9) indicates Parliament did not intend an implied obligation to give prior notice or a hearing before resumption; therefore no right to prior consultation arose and certiorari or mandamus could not lie; application must be dismissed.

A landlord's right to distrain is extinguished when the landlord's title is extinguished by Crown resumption under section 5 of the Crown Lands Resumption Ordinance; consequently a distress executed after the date of resumption is unlawful, although the landlord may still sue for arrears that accrued before resumption.
