Section 4(2) requires proof that (a) a public servant solicited an advantage and (b) the solicitation was on account of the performance (or abstention) of an act in his capacity as a public servant; the act need not be particularised but must be discernible as within the public capacity; mens rea may be established by knowledge that the solicitation is an abuse of office and corrupt intent can be inferred from surrounding circumstances.
