Given the deliberate nature of the attack and the public interest in deterrence for animal cruelty, a community service order is appropriate; 160 hours is within the established range and not manifestly excessive considering the offender's mitigating factors, so the appeal against sentence is dismissed.

The Court held the 6 month custodial sentence was not manifestly inadequate; the offence, while very serious, was not in the most serious category (suffering was relatively short, motive and factual matrix relevant) and the magistrate's assessment of aggravating and mitigating factors produced a justified sentence, so the review application was dismissed.
