Registrar's earlier interlocutory decision was not res judicata on priority after preferred creditors were paid; where a distress warrant was properly served and not discharged under s.104, the landlord's priority under s.265(5) applies to proceeds even if goods were previously in custodia legis; having found workers (preferred creditors) paid in full, the landlord is entitled to priority on the balance up to the statutory limit (six months' rent), and in this case payment to the landlord was ordered for the four months' rent claimed.
