On the evidence and inferences drawn the court found that the plaintiff and her husband had effectively offered Argen for adoption, the defendant accepted and took physical delivery on 25 April 2022 when Terence agreed to take Argen away; the defendant proved donor intention, acceptance and delivery and the plaintiff's later attempts to recover Argen were an attempted revocation which did not undo the completed gift; plaintiff's claim for return was dismissed.
