The Court held that, on sensible reading, indigenous inhabitants of the New Territories are not an 'ethnic' minority for Article 23 purposes and, in any event, the New Territories Land (Exemption) Ordinance, Cap.452 does not infringe rights protected by the BORO; moreover the statement of claim disclosed no private legal right and the matter should properly proceed, if at all, by judicial review, so the writ and statement of claim were properly struck out and the appeal dismissed.
