Section 6A(b) of the Drug Addiction Treatment Centres Ordinance operates only where the subsequent imprisonment term exceeds two years; the magistrate's contrary factual statement justified granting leave to appeal out of time, and because Correctional Services determined the appellant was no longer addicted and unsuitable for DATC, the proper remedy was to quash the DATC Order.
