Plaintiff proved causation only for the first period (May–July 2007) linking seepage to defendants' renovation of their bathroom, but defendants took reasonable and timely remedial steps so there is no liability under the DMC or tort of nuisance; plaintiff failed to prove causation for the second to fourth periods (2010–2012) in light of inconclusive Joint Office tests and lack of contemporaneous evidence; therefore the claim is dismissed and costs awarded to defendants.
