On the balance of probabilities the defendant was negligent: he was travelling at about 40 mph, failed to use raised headlights or keep proper lookout, and there was no bus to excuse his conduct; plaintiff was partly negligent for crossing away from the zebra crossing and misjudging safety, but the defendant was 70% at fault and the plaintiff 30%; liability is therefore apportioned 70/30 and costs ordered against the defendant, with quantum of damages to be determined later.
