Colour water tests and expert evidence established that seepage originated from the defendant's upper flat; defendant was therefore liable in private nuisance. Damages were assessed at HK$62,900 for necessary repairs, HK$241,120 for loss of rent from 19 July 2016 to date of assessment, and HK$20,000 for distress and inconvenience; the HK$23,000 surveyor fee paid by the prior owner was not recoverable. Interest and costs were awarded accordingly.
