Leave to appeal was refused because the sentence was not manifestly excessive: the offence involved a sustained, gratuitous and unprovoked assault by a man with a propensity for violence on a vulnerable, much older taxi driver in the early hours, with multiple aggravating features (multiple blows, intoxication, threats, participation of another assailant, flight from scene) justifying the five-year sentence and the judge's deterrence-related comments.
