On the facts there was insufficient evidence to prove an accident that caused or contributed to the deceased's death; unexplained sudden death alone does not satisfy 'injury by accident' under s.5—the claimant must prove an undesigned untoward event in the course of employment that caused or accelerated death; absent such proof the appeal is dismissed.
