The Court found on the facts that the goods were being sold as genuine and purchasers were deceived, that a deterrent sentence was required given the quantity, value and reputational damage, and that although mitigation (first offender, plea, medical and family circumstances) warranted some reduction, they were not sufficient to avoid immediate imprisonment; accordingly the magistrate's starting point of six months was reasonable and the sentence was reduced from four months to three months imprisonment on appeal.
