The Plaintiff failed to discharge the burden of proof for a common intention constructive trust. The contemporaneous 1991 handwritten declaration, supported by conduct and documentary evidence, established the common intention that the beneficial ownership of the Flats rested with the sons; the Plaintiff's account was inconsistent and not credibly supported. Therefore the Plaintiff's claims are dismissed and declarations are made that D2 is sole beneficial owner of Flat 5A and D3 is sole beneficial owner of Flat 6A.
