Reading the Deposit Agreements and plans, the Auction Notice (with special conditions), the New Grants, file note M10 and the October 1957 memorandum together in their factual context, the Government clearly and unambiguously manifested an intention to grant a right of way over the approach road to the purchasers/owners of Lots 1469/1470/1471; that right of way is therefore an express grant 'by virtue of' an instrument for the purposes of r18A(3)(a)(iv).
