The Court found that the predominant reason for the Plaintiffs' dismissals was their perceived participation in union activities and the dismissals were therefore unfair under the Employment Ordinance; Cathay breached its contractual DGP by not affording disciplinary hearings so wrongful termination damages are payable; the public statements by management were defamatory, Cathay failed on justification and qualified privilege and substantial general and aggravated damages are warranted.
