Given the Joint Office investigation and Nuisance Notice establishing the seepage originated from Flat 10C, the statutory and case law principle that joint tortfeasors’ liabilities are joint and several and severable, and the absence of the 1st Defendant to defend, it was fair and just to exercise the court’s discretion to enter interlocutory default judgment against the 1st Defendant and grant mandatory and prohibitory injunctions and costs against him despite the 2nd Defendant having filed a Defence.
