On the pleaded facts the plaintiff had shown continuous exclusive possession and the requisite intention to possess the Property for more than the statutory period; therefore the defendant's title was extinguished under Limitation Ordinance ss7(2) and 17 and, in the exercise of the court's discretion and given the absence of any defence or meaningful prospect of challenge, declaratory relief was appropriate and granted on the pleadings.
