Although the magistrates were entitled to view the appellant's conduct as blameworthy and to exercise their habitual warrant procedure, the combination of multiple magistrates handling the matter and evidence that the appellant had attempted payment produced mitigating circumstances; the original $200 costs order was therefore disproportionate and was substituted with a nominal $20 costs order.
