Leave to appeal was granted because the respondent conceded leave on the certified questions of law which are of great and general importance and it was arguable that the Court of Appeal's judgments may have caused substantial and grave injustice; the appeal will be heard with Chan Chi Wan Stephen on 21 February 2017.

The Court dismissed the s32(2) certification applications because the applicants did not explain the delay, the legal principles relied on are already well established, Questions 1 and 2 are fact‑sensitive and unsuitable for certification, and Question 3 is not reasonably arguable; accordingly no point of law of great and general importance was certified.

The Magistrate correctly found on the evidence that the injured person was an employee rather than a subcontractor based on provision of tools, regular hours, supervision, leave procedures and monthly payment, and that the appellant had no reasonable excuse for failing to notify the Commissioner or to make periodical payments; the appeal against conviction was therefore dismissed.
