The magistrate's acceptance of the prosecution witness's account was reasonable and unshaken; the appellant's contrary account was properly rejected on credibility and inference; the common law defence issue was not argued below and would not assist because the appellant claimed he was told no written permission was required rather than that he believed he had written permission; the sentence imposed under the statutory fixed penalty regime was lawful and not manifestly excessive, therefore both conviction and sentence are upheld.
