The appeal court held that, although the conviction was properly entered by the magistrate, the fresh mitigating material (reformation, remorse and cessation of the conduct) not before the magistrate made it appropriate to vary the sentence by suspending the three‑month term for two years and substituting a fine of HK$14,000 with one month default imprisonment.
