The Court upheld the trial judge's factual finding that the plaintiff was not carrying on the business of money lending; business-like documentation, fees and administration, given the use of an experienced agent and group resources and the small number of loans, were insufficient to establish a lending business. As that factual conclusion was not clearly wrong, the appeal was dismissed.
