The court found there was a serious issue to be tried, that damages would be inadequate because the plaintiff would be effectively locked out of his land pending trial, and that the balance of convenience favoured a limited interlocutory injunction protecting plaintiff's access; accordingly an order nisi granting the injunction was appropriate pending a full trial.
