The Court held the ERO is constitutional: it authorises the CEIC to make emergency subsidiary legislation without impermissibly delegating general legislative power because such delegation is appropriately limited by the ERO's internal constraints, judicial review, LegCo negative vetting and Basic Law safeguards.
