The court held the alleged forbearance agreement did not prevent the plaintiff from bringing the claim after the forbearance period expired and did not afford the defendant an arguable defence to summary judgment; the cheques were not shown to have been delivered in escrow so as to prevent enforcement under s.21(2) and the defendant's counterclaim did not defeat summary judgment; the Master's Order 14 judgment for US$850,000 was therefore upheld subject to a variation of the interest provision and the application for security for costs was dismissed.
