The court found all three legal requirements for donatio mortis causa satisfied: the Deceased expressed an intention to give the Property and Shares in contemplation of death; she delivered the indicia of title by instructing the 2nd Plaintiff to retrieve the safe deposit box key and the share certificates and title deeds; and the gifts were conditional and became absolute on death. Therefore legal and beneficial title to the Shares and the Property passed to the 1st and 2nd Plaintiffs by donatio mortis causa.
