Because the Plaintiff had paid the development costs under the Agreement thereby establishing ownership under clause 2(c), and because the Plaintiff demonstrated a strong arguable case combined with greater risk of injustice if relief were refused (the Defendant's financial position and conduct suggested inability to meet damages and uncertainty), the court ordered delivery up and preservation of the tooling and required verification of compliance by Mr Chow; no payment into court was ordered for the Defendant's cross-claims at this stage.
