Defendant's account was wholly contradicted by contemporaneous documents and circumstances (solicitor's letter admitting company ownership, employer's return showing Defendant's reported income excluded instalment payments, lack of written evidence of any loan or transfer). His evidence was found incredible and a sham; therefore he had no real or bona fide defence and summary judgment was proper ordering delivery up of the vehicle and costs.
