The summons to restore proceedings was misconceived because the plaintiff already held the three postdated cheques and could not, by enforcement, be put in a better position than possession of those cheques; consequently there was no basis to accede to the application, and although the defendant was late in delivering the first cheque by two days, the appropriate order was dismissal of the summons with no order as to costs.
