The appellant had persistently breached probation and reoffended while on probation, demonstrating that community-based measures had failed; given his youth and sentencing principles that imprisonment is a last resort, Detention Centre sentences were the appropriate custodial disposal and therefore the appeal is dismissed.

The plea and admissions were unequivocal and there was no evidence the appellant was misled; the contemporaneous reports justified Detention Centre as the only realistic sentence for this juvenile offender, therefore the magistrate's sentencing decision was appropriate and the appeal was dismissed.

The Court upheld the magistrate's detention and compensation orders because section 98 authorises a compensation order up to $100,000 including when combined with detention, the magistrate made proper enquiries into the appellant's means and set a finite instalment schedule, and the appellant had the opportunity to make restitution but did not.

The magistrate was entitled to find a case to answer and to convict: the circumstantial link of the identified necklaces to the victims and their presence in the vehicle owned/occupied by the defendants shortly after the attack, combined with D3's evidence placing the appellants at the scene and leaving immediately after, justified an inference of joint enterprise; the magistrate properly cautioned about accomplice evidence and correctly imposed detention centre sentences for the violent group attack.
