The Court dismissed the application for leave to appeal and upheld the sentencing judge's decision that detention at a Training Centre was the appropriate sentence; drug addiction did not legally justify leaving the applicant in DATC or reducing the custodial sentence under the existing law and rules.

The Court held that the offender's youth, lack of prior convictions, adverse social background, supportive family and a correctional report indicating suitability for training constituted cogent/exceptional reasons to depart from Mo Kwong-sang and to uphold the training centre detention imposed by the trial judge rather than impose imprisonment.
Detention at a training centre was disproportionate for the petty offence; having served over three months, the first appellant must be released forthwith; the second appellant requires supervision to avoid risk of prostitution and should be placed on probation for one year.
