The court held that subsidiary legislation validly enacted under the enabling provisions cannot be invalidated for irrationality alone; TGCI and CIC detainees are not comparable because of a legitimate, evidenced policy to concentrate higher security risk detainees in TGCI; the differences in treatment are rationally connected to legitimate aims and are not disproportionate in context (and some differences were to be addressed legislatively); accordingly there was no reasonably arguable case of unlawful unequal treatment and leave to apply for judicial review was refused.
