The Court held that judicial review proceedings permit the court to examine documents claimed to be privileged and that the Commissioner cannot lawfully continue to detain or unseal and examine documents that are in fact covered by legal professional privilege; accordingly the privilege issue must be remitted to the first instance judge for determination before any unsealing or examination.
