The court exercised its discretion under O.15 r.6(2)(b)(ii) to allow LPC to be joined as 2nd Respondent because LPC's challenge to Guy Lam's authority was not bound to fail and was 'fairly arguable'; therefore LPC has a sufficient interest for joinder and should be heard substantively on the question of Guy Lam's locus to bring the Norwich Pharmacal application.
