The Court allowed the appeal in part because the endorsement on the writ was sufficient to treat the causes of action as not 'new' under the Limitation Ordinance and because a case framed consistently with the propositions about converted notes loss is reasonably arguable; nonetheless the pleading as then drafted was embarrassing under O18 r19 and insufficiently consistent with the propositions, so the strike-out decision was unwarranted but costs should not follow the event. Given each side had measures of success the Court made absolute the order nisi of no order as to costs.
