The court found on the balance of probabilities that Jimmy did not make an unconditional disclaimer at the Starbucks meeting; the WhatsApp evidence and inherent probabilities supported Jimmy's contemporaneous proposals (conditional set aside for Mother's benefit) and contradicted an unconditional waiver.
