The magistrate's findings that PW1 was credible and correctly identified the appellant were sustainable on the evidence, there was no evidence of any CCTV recording or undisclosed footage, the appellant could have called Tak as a defence witness, and therefore the conviction was neither unsafe nor unsatisfactory and the appeal was dismissed.
