Material non-disclosure was established in respect of the overly wide scope of the Anton Piller Order (imprecise and unnecessary inclusion of numerous Group Companies and an overbroad requirement to disclose cash takings of any Group Company) and the court declined to exercise its discretion to continue the order; accordingly the Anton Piller Order was discharged and the inspection summons dismissed, with discovery to proceed in the ordinary manner and preserved electronic records to be reviewed by defendants' solicitors for supplemental disclosure.
