The court exercised its case management discretion to direct that the affidavits or affirmations filed by the Secretary for Justice in the 17 applications shall stand as the evidence in chief of the deponents provided they attend trial to be cross-examined, while preserving the trial judge's duty to order oral evidence in chief (in whole or in part) for any particular witness if necessary to avoid real prejudice or unfairness.
