On the evidence the Court found the written guarantees were genuine and properly executed by both defendants, rejected the existence of any collateral contract capping liability at amounts above an alleged HK$20,000,000 facility, and rejected defenses of misrepresentation, estoppel, non est factum and forgery. The plaintiff proved Sing Kwong’s indebtedness of HK$8,321,486.94 by documentary and oral evidence, and was entitled to judgment; interest and indemnity costs were ordered on a nisi basis.
