The appeal was allowed in respect of Count 3 because the trial judge failed to give adequate legal directions on possession in law (constructive possession/control) distinct from physical possession; that defect could have affected the jury's verdict on Count 3. Accordingly the conviction on Count 3 was quashed and a retrial ordered. The appeal against Count 2 was dismissed.
