The Court held the appellant did not prove material non-disclosure. The documentary and affidavit material did not establish that the bank's claim was a mere agent's claim for repayment of a loan; the deposit slip relied upon was before the judge and the plaintiff's case that it acted as a discounting/negotiating bank was adequately disclosed. Accordingly the Mareva order was properly continued and the appeal was dismissed.
