The court held that while electronic files stored on a mobile phone can constitute documents or a computer database for discovery, the plaintiffs failed to establish a prima facie case of relevance and necessity for forensic inspection and the scope sought was disproportionate and intrusive of privacy; accordingly the court would not exercise its discretion to order the discovery and awarded costs to the defendants.
